REVIEW OF BID PROTESTS FINDS CITY COMPLIED WITH PROCUREMENT LAWS AND PROCEDURES

(Fri., June 24, 2011) – The City's Department of Budget and Fiscal Services (BFS) has rejected two bid protests regarding the awarding of the core systems contract for the Honolulu Rail Transit Project.           

            BFS found "no procedural or legal violations in any aspect of the procurement" for the contract.      

            "The protests were thoroughly reviewed, each point was considered, and on all counts the finding was that procurement law and procedures were followed throughout the evaluation and selection process," said BFS Deputy Director Nelson Koyanagi.

            The City has notified the two offerors who filed protests – Sumitomo Corporation of America and Bombardier Transportations (Holdings) USA Inc. – that their claims were rejected. The core systems contract, which consists of manufacturing the train vehicles and providing the system's control center, was awarded to Ansaldo Honolulu in March. 

            As to Sumitomo, despite its claims to the contrary, the City's review found that Ansaldo was in fact a qualified offeror and Ansaldo's proposal provided the best value for taxpayers. Sumitomo's allegations were reviewed and found to be unsubstantiated, according to the letter from the City. 

            Other findings of the review include:

  • Sumitomo's allegation that Ansaldo's pricing for the contract is higher than Sumitomo's is simply false.

            While operation and maintenance costs and design-build costs varied for both vendors, the pricing evaluation was "based on the entire proposal, not individual segments," the City's response to Sumitomo stated. It is indisputable that the cost to taxpayers would be lower under the Ansaldo proposal considering both DB (design-build) and O&M (operation and maintenance) costs, the letter said.

            Sumitomo's allegation that Ansaldo's pricing is imbalanced because it shifted design-build costs to operation and maintenance costs is not supported by the facts, the investigation showed. In addition, Sumitomo's pricing with much larger payments up front is not in the taxpayers' best interest, the review found.

  • Sumitomo's claim that the City did not properly consider Ansaldo's past performance as part of the bid proposal is incorrect.

            Past performance records for all three offerors of the project, including Ansaldo, were evaluated during the first part of the Request for Proposals (RFP) submitted by the offerors. All offerors were required to submit previous records involving completion schedule, quality of work, claims history, terminations, disciplinary actions, and safety records.

  • Sumitomo's assertion that Ansaldo was non-compliant in regards to its train control system is not factual.

            Ansaldo's specifications meet the requirements of the RFP, the letter stated.

            As to Bombardier, the City's review concluded that Bombardier's claim that the City's contract selection process was flawed, is unfounded.

            This review also noted that Bombardier's proposal did not follow the City's guidelines.

  • Bombardier's bid proposal was submitted with conditions to cap its liability, making the bid non-responsive, or ineligible.

            "It is undisputed by Bombardier that its proposal was conditioned," the letter stated.

            According to the letter, the City repeatedly cautioned all three offerors that conditioned proposals would be rejected. In addition, the Hawaii Administrative Rules governing procurement state: "Any offer which is conditioned upon receiving a contract other than as provided for in the solicitation shall be deemed nonresponsive and not acceptable."

            The review determined that Bombardier provided no credible reason to reverse the decision that it was non-responsive and had conditioned its proposal, and denied the company's request to rescind the award.

            The protestors may appeal these decisions within seven calendar days to the Office of Administrative Hearings at the State Department of Commerce and Consumer Affairs (DCCA) by requesting an administrative hearing. The DCCA hearings officer must issue a decision within 45 days of an appeal.

MAYOR CARLISLE: $55 MILLION FOR RAIL IS GREAT NEWS FOR HONOLULU

(Fri., June 24, 2011)—Mayor Peter Carlisle today issued the following statement regarding the Federal Transit Administration's decision to award Honolulu the full $55 million that President Obama had requested.

"This is excellent news and a testament to the strength of Honolulu's rail project. The fact that, in a climate of cutbacks, Honolulu's project was able to get the full $55 million speaks volumes about the federal support for this project. This is a major achievement and positions us well for future funding requests—and we are grateful to Hawaii's Congressional delegation for their support.

"These federal funds move us closer to achieving our goal of providing a transportation alternative to our congested roads and highways. This will also allow us to plan for a better future and enhance the quality of life for our residents for decades to come. This is great news for Honolulu."

Rehabilitation of Secondary Streets at Makiki - Kinau St from Alapai St to Waiau Pl, Wilder Ave from Spencer St to Dole St. and Dole St from Wilder Ave to St. Louis Dr.:  The project will demolish, remove and dispose of existing pavements in Honolulu area. Resurface or reconstruct these streets with asphalt concrete pavement.  Adjust manholes and monuments to road grades.  Restore all pavement striping, markings and markers.  Collect GPS data on manholes, street monuments, valve boxes, fire hydrants, and other features as directed by the City before construction begins.  Wilder Ave and Dole St, paving completed.  Kinau St. will start after the State project in the Kinau off ramp is completed.

Mapunapuna Industrial Subdivision Phase One of Tidal Flooding Remediation Program.  Remove existing flap gates and install new check valves at outlet pipes in State channel fronting Kam Highway. Construct new DMH upstream of new check valves. Re-grade swale and adjust DI to provide positive drainage into existing drain system. Upgrade concrete wall at outlet pipes at State channel. Remove debris and sediment from existing storm drains and channel area. Dewater State channel and install temporary dewatering dams.  At the intersection of Ahua Street and Awaawaloa Street, abandon existing storm drain on Ahua Street and install new storm drain MH on upstream end of abandoned pipe.

            (Estimated completion date, June 2011)

 

Mokauea Street Improvements between North King Street and Dillingham Boulevard:  Reconstruction concrete curbs and gutters, driveway and some sidewalks; construct new curb ramps; reconstruct and resurface asphalt roadway.  Post paving activities include installation of permanent pavement markings, adjust utilities to finish grade, and re-install traffic loop detectors.

            (Estimated Completion June 2011)

 

Sewer Manhole and Pipe Rehabilitation at Various Locations – Phase 2:  Various manhole rehabilitation along Nimitz Highway between Pacific Street and Sumner Street.

Curb Ramps at Various Locations, FY 2009 (B), Palolo and Kaimuki:  Construction of new curb ramps, sidewalks and A.C. transition.  Relocation of existing regulatory/street signs. Installation of pavement striping, markings and markers.

Peterson Lane and Pua Lane Sewer Rehabilitation:  New sewer line and manhole installation in complete on King Street (between Dillingham Blvd. and Peterson Lane), Pua Lane and Peterson Lane.  Repaving of King, Peterson and Pua Lane is complete. Punchlist items and reconstruction of Tamashiro Market driveway remain.  One lane in each direction will be closed Monday thru Friday, 8:30 a.m. to 3:30 p.m.

Rose Street/Kam IV Road (SMPR 66) and Richard Lane/Linapuni Street (SMPR 67) Sewer Rehabilitation:  Installation of new sewer lines/manholes and reconnection of existing sewer laterals along Richard Lane, Linapuni Street, Kahauiki Street, Kamehameha IV Road between Kahuiki Street and Owene Lane, and Rose Street.

            (Estimated completion date, July 2011)

 

Saint Louis Heights Sewer Rehabilitation:  Installation of cured in place pipe (CIPP), manhole rehabilitation, and lateral rehabilitation throughout Saint Louis Heights.  The contractor will also install new sewer lines via pipe bursting at 3 locations along Saint Louis Drive and one easement location between Saint Louis Drive and Frank Street.

            (Estimated completion date, June 2011)

 

Wilhelmina Rise Sewer Rehabilitation:  Installation of cured in place pipe (CIPP), lateral rehabilitation, and replacement of sewer lines by open trench.

KAILUA

Rehabilitation of Streets Indefinite Delivery/Indefinite Quantity IDIQ #3 – Aikahi Park.  The scope of work to be performed by the Contractor under this contract may include, but is not limited to: cold planning; slurry seal; crack seal; reconstructing curb and gutters/rolled curbs; resetting of lava rock curbs; aboricultural work; adjusting street survey monuments, utility manholes/boxes, frames and covers; installing pavement striping and markings; and reinstalling vehicle detector loops.  Slurry seal is in process.

Rehabilitation of Streets, Unit 52 – Keolu Drive (Kalanianaole Highway to Akahai Street); Keolu Drive (Akaakaawa Street to Wanaao Road):  Cold planing; resurfacing and reconstruction of asphalt concrete pavements (ACP); adjustment of utility manhole frames and covers; installation of pavement markings and vehicle loop detectors; reconstruction of existing concrete curbs, gutters, sidewalks and Driveways; reconstruction of concrete catch basins; and construction of concrete and asphaltic concrete bus pads.

Rehabilitation of Streets Indefinite Delivery/Indefinite Quantity IDIQ #3 – Honokai Hale.  The scope of work to be performed by the Contractor under this contract may include, but is not limited to: cold planning; slurry seal; crack seal; reconstructing curb and gutters/rolled curbs; resetting of lava rock curbs; aboricultural work; adjusting street survey monuments, utility manholes/boxes, frames and covers; installing pavement striping and markings; and reinstalling vehicle detector loops.  Slurry seal to begin.

Waimalu Sewer Rehabilitation/Reconstruction Phase I:  Installation of new sewer lines/man holes and reconnection of existing sewer laterals along Hekaha, Kanuku, Lokowai, Lii-Ipo, Pahemo, and Olepe.

Waimalu Sewer Rehabilitation/Reconstruction Phase II:  Installation of new 8" and 12" sewer lines along Hekaha Street between Kanuku Street and Moanalua Road.

PUPUKEA

Pupukea Road Rockfall Mitigation Phase I – Pupukea, Oahu:  The work consists of clearing vegetation within the project limits, scaling boulders and unstable rocks or installing rock dowels (where appropriate), applying shotcrete (where required), installing rock fall protection fences, drapery system and landscaping. One traffic lane will be closed during work hours at Pupukea Road with police performing traffic control duties. Contractor is scheduled to begin work in May 2011.  A one lane closure will occur during work hours between 8:30 a.m. and 3:30 p.m. starting on May 16, 2011.

Mailiili Stream Flood Control Improvements – Near Halona Road and Puuhulu Road:  Removal and reconstruction of damaged concrete channel lining, construction of new channel access ramp near Halona Road Bridge, and construction of overflow side-drains on the channel banks.
